YES, eligible contractors receive compulsory superannuation from the business hiring them. Australian super guarantee (SG) law treats some contractors as employees for SG purposes when they are engaged mainly for their personal labour. An ABN, invoice or description as an independent contractor does not settle eligibility. The assessment depends on the contracting party, labour terms, right to delegate and whether payment is for a specified result.
Do contractors get superannuation in Australia?
YES, some independent contractors in Australia receive super. A hiring business generally pays SG when an individual works under a contract principally for their personal labour and skills. An ABN does not remove the obligation. A genuine contract for an independently delivered result or a contract with a company is different. Special provisions also cover certain performers and people providing services connected with performances.
Who has to pay compulsory superannuation for a contractor?
The business engaging an eligible individual contractor is responsible for paying SG directly into that worker's complying super fund. The contractor does not invoice for the SG amount or receive it as cash. An independent sole trader outside the compulsory SG rules normally makes their own voluntary contributions, subject to contribution caps and tax treatment. The self-employed super guide explains personal contributions.
What does principally for labour mean for contractor super?
A contract is principally for labour when its main purpose is the individual's personal work and skills, rather than equipment, materials or delivery of an independently contracted result. The ATO's assessment includes whether labour makes up more than half the contract's value, whether the person must perform the services personally and whether payment is tied to time and effort rather than an outcome. A genuine contractual right to delegate can change the conclusion.
Before deciding whether SG applies, check the agreement in this order:
- Contracting party: Is the hirer contracting with an individual or sole trader rather than a separate company?
- Main value: Does personal labour represent more than half the contract value?
- Personal performance: Must that individual do the work, without a genuine right to delegate it?
- Payment basis: Is payment principally for time, effort or skills rather than an agreed result?
These are practical indicators of the extended employee definition, not a substitute for reviewing the actual contract. A worker who is an employee under the ordinary meaning of that term can also attract SG independently of this contractor test.
Does holding an ABN remove super entitlement?
NO, holding an ABN does not remove entitlement. The ATO assesses the substance and legal terms of the engagement for SG purposes, including personal work, payment basis and delegation rights. A sole trader paid hourly to undertake the work personally can still qualify.
How do individual and company contracts affect super liability?
A contract with an individual or sole trader can trigger SG where the personal labour test applies. When the hiring business contracts with a separate company to provide services, the individual supplying the work is generally not its employee under the extended labour-contract definition. The company may have its own SG obligations towards its employees or directors. Identify the actual contracting legal entity before assessing liability.
Are subcontractors assessed under the same super guarantee rules?
YES, subcontractors are assessed against the same relevant SG tests rather than an automatic exemption. An individual subcontractor whose agreement principally requires their personal labour can be eligible. A subcontractor hired to supply a defined result with a genuine right to delegate, or a company engaged to supply services, may fall outside that particular test. Consider other statutory employee provisions separately.
How much super is payable for eligible contractors?
The SG rate is 12% for payments made from 1 July 2025. Under Payday Super from 1 July 2026, SG generally applies to qualifying earnings, including payments for labour to contractors treated as employees under the extended definition. For example, $2,000 in eligible labour earnings produces $240 SG (12% × $2,000). This is an illustrative calculation, not an assessment of a particular contract. The earnings base and contract details must be established before using the calculation. The super contributions calculator provides a general estimate; confirm the contractor's qualifying earnings separately. The Payday Super rules explain the current contribution timing.
Is contractor super payable on GST or materials?
NO, GST and separately identified genuine materials or equipment costs are not automatically part of the contractor's qualifying labour earnings. Calculate SG using the amount properly attributable to covered labour or performance work, according to the governing rules. When the invoice does not identify the labour portion, the ATO permits a reasonable estimate using relevant market or industry rates. Do not subtract an arbitrary amount. Keep itemised invoices, contracts and the basis of any estimate.
Illustrative invoice (AUD): A sole trader bills $2,000 for eligible personal labour, $300 for separately identifiable materials and $230 GST on the $2,300 taxable subtotal. If the worker meets the SG eligibility tests and the $2,000 labour amount is wholly qualifying earnings, the employer SG is $240 (12% of $2,000). Neither the $300 materials charge nor the $230 GST is added to that labour base. The example assumes no other adjustments or exclusions.
When do hirers have to pay super for contractors in 2026?
From 1 July 2026, Payday Super requires businesses to calculate and pay SG for each payment of qualifying earnings to an eligible contractor. When the contractor invoices the business, payday is the date the invoice is paid. The receiving fund generally must receive the SG contribution within seven business days after that date. Specific extensions apply in defined circumstances. For pre-July 2026 periods, the prior quarterly SG rules and transitional liabilities still matter. For example, if the hirer pays an eligible contractor's invoice on a Monday, that payment date starts the ordinary seven-business-day receipt period. The actual deadline depends on public holidays and statutory exceptions. Reconcile payment dates, amounts, fund receipts and any rejected transactions.
How can a contractor check whether super was paid?
A contractor can check their super fund's transaction history and ATO information through myGov to compare received employer contributions with eligible work payments. For a basic estimate of employer super, use Superannuation Calculator Australia after identifying the correct qualifying earnings. Fund receipt dates can differ from invoice payment dates. Save invoices, contracts and payment records before contacting the hiring business about a missing amount. See the guide to checking your super balance for account-checking steps.
What should a contractor do if super was not paid?
Contact the hiring business with the relevant invoice dates and fund transaction records, then use the ATO unpaid-super reporting process if compulsory contributions remain missing. Include the hirer's identity, dates worked, amounts paid and the agreement. The ATO investigates SG compliance; it does not treat every commercial contract dispute as an unpaid-super claim.
Which documents help establish contractor super eligibility?
Keep the signed agreement and amendments, invoices itemising labour and non-labour components, timesheets or rosters, payment receipts, fund statements and messages about substitution or delegation. These records help show who contracted, who performed the work, whether payment was for effort or a result and when qualifying earnings were paid.
How do common contractor arrangements change SG outcomes?
The outcome turns on the actual contractual obligations rather than the job title. A sole-trader administrative assistant paid hourly to work personally commonly meets the labour test, provided the remaining legal criteria are met. A business hired to install equipment for a specified result, using its own labour and a genuine right to delegate, is assessed differently. A Pty Ltd supplying a consultant under a corporate services contract generally places employer SG responsibility with that company, not automatically the client.
| Arrangement | Indicative SG position | Key evidence |
|---|---|---|
| Individual paid hourly for personal work | Likely SG eligible | Individual contract; timesheets; no delegation |
| Contractor paid for a defined deliverable with genuine substitution rights | Often outside the principally-for-labour test | Results agreement; contractual right to delegate |
| Client contracts with a Pty Ltd supplier | Client generally not liable under the individual labour-contract test | Company agreement; business invoices |
The table compares likely SG treatment, not automatic exemptions or entitlements. Actual outcomes depend on the legal agreement and applicable law.
How can independent contractors contribute to their own super?
Independent contractors not entitled to hirer-paid SG can make personal contributions to their super fund. Whether contributions are tax deductible, count towards concessional or non-concessional caps, or qualify for a government co-contribution depends on the worker's circumstances. Check current ATO contribution rules and provide the fund with a tax file number. Contractors planning voluntary contributions can use the super projection calculator to illustrate longer-term effects; projections are estimates rather than guaranteed outcomes.
Are creative contractors covered by special super provisions?
YES, additional SG employee definitions cover certain people paid for performing or presenting, and services directly connected to performances, recordings or broadcasts. Coverage can extend to singers, actors, production technicians and stage crew even when their contracts are for a result. A painter or writer selling a completed work is not automatically covered by those provisions. Assess the actual service and statutory category.
What happens if a business fails to pay required contractor super?
An employer that misses compulsory SG can become liable for the super guarantee charge and related compliance action. The ATO treats cash paid to a contractor in place of compulsory fund contributions as insufficient. The calculation and treatment differ between historical quarterly periods and Payday Super periods. Businesses should correct rejected payments promptly, keep transaction evidence and follow ATO reporting instructions rather than paying the missing contribution directly to the contractor.
Can an ABN contractor receive super?
YES, an ABN contractor can receive super when the contract meets SG's extended employee definition or another applicable statutory category. ABN registration does not determine SG status.
Does being paid by invoice remove SG entitlement?
NO, an invoice does not cancel SG entitlement. The contract terms and personal labour arrangements determine whether the hirer must contribute to the contractor's fund.
Can a contractor qualify for SG while having multiple clients?
YES, working for multiple clients does not automatically exclude a contractor from SG. Assess each engagement separately, including the labour requirement, contracting party and delegation rights.
Can a hirer pay super as cash instead of into a fund?
NO, compulsory SG must be paid to a complying super fund, not added as cash to the contractor's bank transfer or invoice amount. The hirer remains responsible for the super payment.
Does an eligible contractor choose their own super fund?
YES, an eligible contractor generally has super fund choice arrangements. If no fund is chosen, the hirer checks for a stapled fund and applies the relevant default-fund rules.
Do contractors under 18 automatically qualify for SG?
NO, contractors under 18 do not automatically qualify. The general SG rule for employees under 18 requires more than 30 hours' work in a week, alongside the relevant status rules. Special award or agreement provisions can create further entitlements, including for some young performers. Check the applicable instrument before concluding no SG is due.
